Terms of service

These terms are an agreement between you and the seller named below (“we”, “us”) covering your use of keklik.io and the application at https://app.keklik.io (together, the “Service”). By creating an account or using the Service you accept these terms. If you do not accept them, do not use the Service.

2. What the Service does

The Service collects publicly available business information from Google Maps and from business websites, on your instruction, and returns it to you as structured data. It offers four collection modules — place search, reviews, listing details, and website contacts — described on our modules pages.

We are an independent service. We are not affiliated with, endorsed by, or sponsored by Google LLC or any other platform whose public data you may collect through the Service.

3. Accounts and access

Access is currently granted by invitation. You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at support@keklik.io if you believe your account has been used without your permission.

You must be at least 18 years old and able to enter into a binding contract. Accounts are for you or your organisation; do not share access with people outside it.

4. Credits, plans and payment

The Service is sold on a credit model. Your plan carries a credit allowance, and collecting data spends credits at the published rates on our pricing page. Those rates and the credit rules on that page form part of these terms.

• Plans are billed monthly in US dollars, in advance.
• Credits are a unit of account for using the Service. They are not money, carry no cash value, and cannot be transferred or redeemed for cash.
• When your balance runs out, runs stop rather than incurring additional charges. Data already collected remains available to you.
• We may change prices with at least 30 days’ notice by email. A price change applies from your next billing period, and you may cancel before it takes effect.

Purchases are processed by Paddle.com Market Ltd, which acts as merchant of record and reseller. Your purchase is therefore also subject to their buyer terms, and they handle payment, invoicing and applicable sales tax or VAT. Refunds and cancellation are covered by our refunds and cancellation policy.

5. How you may use the Service

You must use the Service lawfully. Our acceptable use policy sets out what is and is not permitted, and forms part of these terms.

You are responsible for how you use the data you collect. The Service is a tool that retrieves publicly available information on your instruction. Deciding what to collect, on what legal basis, and what to do with it afterwards is your decision and your responsibility. This includes complying with data protection law (such as the UK GDPR and EU GDPR), electronic marketing law, and the terms of any site you direct us to.

6. Your data and ours

You own the data you collect through the Service. We claim no rights over it beyond what we need to operate the Service — storing it, displaying it to you, and letting you export it.

We own the Service itself: the software, interfaces, documentation and branding. Nothing here transfers that to you. You are granted a non-exclusive, non-transferable right to use the Service for as long as your account is active.

Where the data you collect contains personal data, we process it on your behalf as described in our privacy policy.

7. Availability

We work to keep the Service running but do not guarantee uninterrupted availability. Maintenance, third-party outages, and changes made by the platforms we collect from can all interrupt it.

The Service depends on the public structure of third-party websites, which those parties can change at any time without notice. We maintain the Service in response to such changes, but we cannot guarantee that any particular field, module or volume of data will always be available.

8. Warranties and liability

The Service is provided “as is”. To the fullest extent permitted by law we exclude implied warranties, including fitness for a particular purpose and the accuracy or completeness of collected data. Data is returned as found at the source; we do not verify it.

To the fullest extent permitted by law, our total liability to you arising out of or in connection with these terms is limited to the amount you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data.

Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

9. Suspension and termination

You may stop using the Service and cancel your plan at any time. We may suspend or terminate an account that breaches these terms or the acceptable use policy, that is used unlawfully, or that puts the Service or other customers at risk. Where it is reasonable to do so we will warn you first and give you a chance to put things right.

On termination your right to use the Service ends. Export anything you want to keep before you cancel; see the privacy policy for how long we retain data afterwards.

10. Changes to these terms

We may update these terms. If a change materially affects your rights we will give notice by email or in the application before it takes effect. Continuing to use the Service after that means you accept the updated terms.

11. Governing law

These terms are governed by the laws of Pakistan, and the courts of Pakistan have exclusive jurisdiction over any dispute — except that if you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of your own country’s law.
